GOLF CLUB RULES & BY-LAWS
ALL AS AT 18th MARCH 2010
RULES
1 - NAME
The name of the Club shall be THE TIN CAN BAY COUNTRY
CLUB INC. GOLF CLUB, referred to in these Rules as The Club.
2 - TIN CAN BAY COUNTRY CLUB INC.
These Rules are subject to the CONSTITUTION of THE TIN CAN BAY
COUNTRY CLUB INC.
3 - OBJECTS
The objects of The Club are to promote, encourage and foster the
game of golf on facilities provided by the TIN CAN BAY COUNTRY
CLUB INC., and encourage social interaction between members of The Club.
4 - POWERS -
a. To control and administer the competition game of golf on facilities
provided by THE TIN CAN BAY COUNTRY CLUB INC.
b. To promote and hold, alone or jointly with any other association, club
or person, meetings, competitions and matches for the playing of golf,
and to offer, give or contribute toward prizes, medals and awards
therefor.
c. To establish, promote or assist in establishing or promoting and to
subscribe to or become a member of or associated or amalgamated
with any other Association or Club whose objectives are similar, or in
part similar to the objectives of The Club, or the establishment or
promotion of which may be beneficial to The Club and to join and become a member
of any controlling authority of golf in Australia for the time being.
5 - MEMBERSHIP
a. The membership of The Club shall consist of the following classes of
members :-
i - ORDINARY – Ordinary Members of THE TIN CAN BAY
COUNTRY CLUB INC. who have also paid the current affiliation
fees of GOLF AUSTRALIA
ii - JUNIOR – As per GOLF AUSTRALIA Regulations
iii - NON HOME - Members of THE TIN CAN BAY COUNTRY
CLUB INC. who have not declared Tin Can Bay Golf Club as their
Home Club
iv - LIFE - Life Members will comprise those so honoured and
appointed under the following terms :-
An Ordinary Member on the recommendation of the
Management Committee may be elected as a Life
Member of The Club in honour of special services
rendered by him/her to The Club. Such election shall
be by resolution of a 75 per cent majority of Members
present and entitled to vote at any Annual General
Meeting of The Club of which proper notice has been
given by the Management Committee. Life Members
shall be free to enjoy all Club privileges and exercise all
rights but shall be exempt from payment of the Annual
Subscription to The Club but not of any Levy.
b. The number of these members shall be unlimited.
6 – MANAGEMENT COMMITTEE
a. The Management Committee of The Club shall consist of PRESIDENT,
MEN’S CAPTAIN, LADIES CAPTAIN, VETERANS CAPTAIN,
MEN’S VICE CAPTAIN, LADIES VICE CAPTAIN, VETERANS
VICE CAPTAIN, SECRETARY, TREASURER, LADIES
HANDICAPPER, MEN’S HANDICAPPER and FOUR (4) OTHERS.
b. All officers under these Rules shall be honorary and elective.
c. Every Ordinary Member of The Club shall be eligible to hold office, save
as
is otherwise provided in these Rules and subject thereto.
7 – ELECTION OF MEMBERS TO THE MANAGEMENT COMMITTEE
a. At the Annual General Meeting of The Club, all members of the
Management Committee for the time being shall retire from office, but
shall be eligible upon nomination for re-election.
b. The election of members of the Management Committee shall take place
in the following manner and in accordance with the Association’s
constitution :-
i - Any two Ordinary Members of The Club shall be at liberty to
nominate any other Ordinary Member to serve as a member of the
Management Committee except that only males may nominate the
Men’s Captain, ladies the Ladies Captain and male veterans the
Veterans Captain and similarly for the Vice Captains positions.
ii - The nomination, which shall be in writing and signed by the
Member and Proposer and Seconder, shall be lodged with the
Secretary at least seven (7) days before the Annual General Meeting
at which the election is to take place.
iii - The secretary shall list all nominations on the Notice Board as soon
as practicable after receipt, but not later than seven (7) days before
the Annual General Meeting.
iv - Any contested election shall be by secret ballot but only males may
vote for the Men’s Captain, ladies for the Ladies Captain and male
veterans for the Veterans Captain and similarly for the Vice
Captains positions.
v - Should at the commencement of the Annual General Meeting there
be insufficient number of candidates nominated, nominations may be
taken from the floor of the meeting
vi - Any member of the MANAGEMENT COMMITTEE may resign
from the Committee at any time by giving notice to the Secretary in
writing, but such resignation shall take effect at the time such notice
is received by the Secretary unless a later date is specified in the
notice when it shall take effect on that later date or such member
may be removed from office at a General Meeting of the Club where
that member shall be given the opportunity to fully present his case.
The question of removal shall be determined by a vote of the
members present at such a General Meeting.
8 – VACANCIES ON THE MANAGEMENT COMMITTEE
a.i) Except in the case of the Captains and Vice Captains, the Management
Committee shall have the power at any time to appoint any ORDINARY
MEMBER of The Club to fill any casual vacancy on the Management
Committee until the next Annual General Meeting
a.ii) For those positions excepted in 8.a.i the Management Committee shall
seek nominations from the male, lady or male veteran ORDINARY
MEMBERS as the case may be. In the event of more than one
nomination being received then a ballot will be conducted accordingly
and the elected Member appointed to the Management Committee until
the next Annual General Meeting
b. The continuing members of the Management Committee may act
notwithstanding any casual vacancy on the Management Committee,
but if and so long as their number is reduced below the number fixed
by or pursuant to these Rules as necessary quorum of the
Management Committee, the continuing member or members may
act for the purpose of increasing the number of members of the
Management Committee to that number or of summoning a General
Meeting of The Club, but for no other purpose.
9 - FUNCTIONS OF THE MANAGEMENT COMMITTEE
a. Except as otherwise provided in these Rules and subject to resolutions
of Members of The Club carried at any General Meeting, the
Management Committee shall :-
i - have general control and management of the administration of the
affairs, property and funds of The Club.
ii - have the authority to interpret the meaning of these Rules and any
other matter relating to The Club on which these Rules are silent.
iii - appoint Sub-Committees as required.
10 – MEETING OF MANAGEMENT COMMITTEE
a. The Management Committee shall meet at least once every calendar
month to exercise its functions.
b. At any Management Committee meeting a simple majority of a number equal to
the number of members elected to the Management Committee at the previous Annual
General Meeting shall constitute a quorum.
c. The President shall preside as Chairperson at every meeting of the
Management Committee, or if there is no President, or if at any
meeting he/she is not present within ten (10) minutes after the time
appointed for holding the meeting then the members present may
choose one of their number to be meeting Chairperson.
d. A Special Meeting of the Management Committee shall be convened
by the Secretary on the requisition in writing by not less than one
third of the members of the Management Committee, which
requisition shall clearly state the reasons why such Special Meeting is
to be convened and the nature of the business to be discussed thereat.
e. Not less than seven (7) days notice shall be given by the Secretary to
members of the Management Committee of any Special Committee
Meeting. Such notice shall clearly state the nature of the business to
be discussed thereat.
f. Subject as previously provided in this rule the Management
Committee may meet together and regulate its proceedings as it
thinks fit, provided that questions arising at any meeting shall be
decided by a majority of votes and in the case of equality of votes, the
question shall be deemed to be decided in the negative.
g. The Management Committee may delegate any of its powers to a Sub-
Committee consisting of such members of The Club as it thinks fit. Any sub-committee
so formed shall in the exercise of the powers so delegated conform to any regulations
that may be imposed on it by the Management Committee.
h. Any member of the Management Committee not attending any three
(3) consecutive meetings without the permission of the Management Committee
shall ipso facto cease to be a member of the Management Committee
11 – DUTIES OF EXECUTIVE OFFICERS
a. PRESIDENT – The President shall conduct meetings in an orderly
manner, attend Sub-Committee meetings as required and carry out executive duties
as may be required.
b. SECRETARY – The Secretary shall carry out all duties as set down
in the Rules and in addition shall :-
i - Attend to all outward and inward correspondence.
ii - Notify all Members of any alteration to the Rules and By-Laws
by displaying a copy of the changed rule or by-law on the notice
board.
c. TREASURER – The Treasurer shall carry out all duties as set down
in the Rules and in addition shall :-
i - Present to each monthly meeting of the Management Committee
a financial statement for the preceding month.
ii - Maintain a record of The Club’s stock.
d. CAPTAIN - Each Captain shall be in charge of all their respective
competition games and in particular will be responsible for :-
i - Application of golf rules and etiquette
ii - The prompt despatch of players at tee-off times
iii - Visiting Competition players as guests in the clubhouse and the
competition book which shall be regarded as the TIN CAN BAY
COUNTRY CLUB INC. visitors book.
iv - The placing of tee markers and holes prior to the commencement
of competitions
v - The inspection of the course as required in conjunction with the
Greenkeeper.
vi - Selecting and chairing their respective MATCH
COMMITTEES
vii - In addition the Men’s Captain shall be considered to be the Club
Captain whose duties will cover all arisings not specifically
mentioned under d i – vi above
e. VICE-CAPTAIN - Each Vice-Captain shall assist with and carry out
the duties of their respective Captains as and when required.
f. LADIES HANDICAPPER - The Ladies Handicapper shall be
responsible for :-
i - The application of the Australian Handicap System and display
of Ladies current handicaps.
ii - Compilation and display of eclectic scores.
g. MENS HANDICAPPER - The Mens Handicapper shall be
responsible for :-
i - The application of the Australian Handicap System and display
of Mens current handicaps.
ii - Compilation and display of eclectic scores.
12 – SUB-COMMITTEES
Where appointed under 9.a.iii herein any Sub-Committee shall carry
out those duties as delegated by the Management Committee and in
accordance with these Rules and the Rules of Golf.
13 – DELEGATE TO COUNTRY CLUB
Within thirty (30) days of the TIN CAN BAY COUNTRY CLUB INC.
Annual General Meeting, a member of its Management
Committee is to be appointed The Club’s official spokesperson at the Country
Club Management Committee meetings.
14 – ANNUAL GENERAL MEETINGS AND GENERAL MEETINGS
The Secretary shall convene all General Meetings of The Club by giving not
less than fourteen (14) days notice of any such meeting to members of The Club
by the placing of a notice on the Notice Boards and by any other means as directed
by the Management Committee.
a. The Annual General Meeting shall be held in November on a date and
at a time set by the Management Committee
b. Business to be transacted at the Annual General Meeting :-
i - The receiving of the Management Committee’s report and
Statement of Income and Expenditure for the year which
Statement shall be displayed on the Notice Board before the date
of the Annual General Meeting
ii - The election of members of the Management Committee.
iii - To receive notices of motion regarding rules and by-laws,
submitted in writing to the Secretary at least fourteen (14) days prior to the
date of the Annual General Meeting and having been posted on the notice board
at least seven (7) days prior to the Annual General Meeting.
c. The Secretary shall convene a Special General Meeting :-
i - when directed to do so by the Management Committee; or
ii - on the requisition in writing signed by not less than the number of ordinary
members of The Club which equals double the number of members presently on the
Management Committee plus one (1). Such requisition must clearly state the reason
why such a meeting is required and the nature of the business to be transacted
thereat
d. At any General Meeting the number of ordinary members to
constitute a quorum shall be double the number of members presently
on the Management Committee plus one (1).
e. A Member SHALL VOTE IN PERSON and on a show of hands.
Every person present who is an Ordinary Member shall have one (1)
vote.
15 – RECORD OF MEETING
The Secretary shall cause full and accurate minutes of all questions, matters,
resolutions and other proceedings of every Management Committee, Special
and Annual General Meeting to be entered in a book to be open for
inspection at all reasonable times by any financial member who previously
applies to the Secretary for that inspection. The minutes of every
Management Committee and General Meeting shall be signed by the
chairperson of the next such meeting, verifying their accuracy.
16 – ALTERATION TO RULES
Subject to the Rules and By-Laws of the TIN CAN BAY COUNTRY CLUB
INC. these rules may be amended, rescinded or added to from time to time
by a special resolution carried at any GENERAL MEETING by a majority
of 75 per cent of the Ordinary Members voting at that meeting.
17 – ALTERATION TO BY-LAWS
The Management Committee may from time to time :-
a) make new By-Laws;
b) amend existing By-Laws;
c) repeal By-Laws not consistent with these rules;
for the internal management of The Club and any By-Law may be set aside
by a General Meeting of Members.
18 – FUNDS AND ACCOUNTS
a. Proper books and accounts shall be kept, showing correctly the
financial affairs of The Club.
b. All monies shall be banked as soon as practicable after receipt.
c. The Management Committee shall determine the amount of petty cash to be held
under the imprest system.
d. All expenditure shall be approved by the Management Committee.
e. Green fees collected by The Club shall be paid to the TIN CAN BAY
COUNTRY CLUB INC. on a daily basis.
f. As soon as practicable after the end of the financial year, the
Treasurer shall prepare a statement containing particulars of income
and expenditure for the year for examination by the Country Club’s
Auditor prior to the Annual General Meeting should such
examination be called for by the Country Club or it’s Auditor.
19 – FINANCIAL YEAR
The Financial year of The Club shall close on the 30th of September.
20 – ENTITLEMENT OF BENEFITS
No Member shall be entitled to any benefit or advantage from The Club
which is not shared equally by every other Member.
21 – SURPLUS FUNDS
The Management Committee shall decide at the October meeting the amount
of surplus funds to be transferred to the Country Club in accordance with
their By-Laws.
BY-LAWS
1 - COMPLAINTS
a. All complaints shall be made to the Secretary in writing and be signed
by the complainant.
b. After entering the complaint in the Complaints Book, the Secretary
shall refer it to the Management Committee with as little delay as possible
and forward a reply under the Management Committee’s direction.
2 – GENERAL CONDITIONS OF PLAY
a. Conditions of play for the Championship Events shall be displayed on
the notice board prior to the event and strictly adhered to.
b. To be eligible for ANY Club Championship or Medal Event,
participants must be a Member, other than a Non Home Member, of
The Club and hold a current GOLF AUSTRALIA handicap. In
addition for Club Closed Championships a participant must have
played at least 3 games on the Tin Can Bay course in the period
following the previous years event. For all other competitions the
participants must hold a current GOLF AUSTRALIA handicap
c. There are no age restrictions on the use of motorised bikes and buggies for
any Club competitions. Members should be aware, however, that the
conditions of play for non Club events may prohibit the use of motorised
bikes and buggies without the production of a medical certificate where
required.
d. Individual events on Saturdays and Public Holidays to be played as two (2)
competitions, Men’s and Ladies’, (i.e. separate trophies for Men
and Ladies) unless advised otherwise by notice (i.e. Fixture Book, Notice Board
or Timesheet etc.).
NB i) Play may be in mixed groups and there will usually be one ball
rundown, one set of pin shots and one runner-up.
ii) Partner events on Saturday to be Medley events unless advised
otherwise.
iii) Sunday events to be Mixed (individual) and Medley (partners)
unless advised otherwise.
e. Minimum fields at weekends or Public Holidays shall be fifteen (15)
players for single events and twenty four (24) players for partner
events. A Club Trophy may be made available for smaller fields at
the Match Committee’s discretion.
f. For multi-day events the nomination fee will be charged on the first day
of such events.
g. Players disqualified or NCR will generally be eligible for pin shots and
the Eagle’s Nest.
h. For all Four Ball events only one pin shot trophy to be given out for the
actual pin shot.
i Competitors may practice on the course on the day of their Match Play
playoffs.
j. ECLECTIC - Lowest score at each hole in Medal and Club
Championship Rounds. Deduction of half handicap as at last day of
Eclectic Competition
k. Should a competition be won by the trophy donor then the runner-
up shall receive the donated trophy and the donor shall receive 2 balls
l. The Match Committees reserve the right to alter Conditions of Play
for any event at any time
m. For all Medal of Medals events a medal will be awarded for each
Division
n No member shall play in more than one event/competition on a single day,
this including the playing of a Match Play playoff as part of the Thursday
and Friday 9 hole competitions.
o AMBROSE EVENTS
oi – For official club competitions which shall be limited to players
with a
current GOLF AUSTRALIA handicap, the maximum handicap for
Ladies shall be 45 and for Men 36.
oii – For all other Ambrose events where players without a current GOLF
AUSTRALIA handicap are allowed to participate the maximum
handicap for such participants shall be 18 for both Ladies and Men.
p DISPUTES
p.i Any disputes or protests arising in respect of a competition must be referred
to the Match Committee for the day within 30 minutes of completion of
play. The Match Committee decision is final
p.ii Should any member or player need to raise any other type of query in
respect of an occurrence during or in connection with an event then they
should do so with the Captain of the day i.e. the Veterans Captain for
Veterans days, the Ladies Captain for Ladies days and the Men’s Captain
for weekend and any other events for which he is responsible.
p.iii Where such a query or any other arising requires to be referred to any
golfing authority then contact with that body should be made by the
Captain of the day as above.
r. DISTANCE MEASURING DEVICES
For all Club events a player may obtain distance information by using a device
that measures distance only. However, if during a round, a player uses a distance
measuring device that is designed to gauge or measure other conditions that
might affect their play (e.g. gradient, wind speed, temperature etc.) the player
shall be disqualified regardless of whether any such additional functions are
actually used.
3 - LADIES CONDITIONS OF PLAY
a. Any member wishing to obtain a handicap and use Tin Can Bay as her Home
Club must return three (3) eighteen (18) hole stroke round score cards played
from the GOLF AUSTRALIA Ladies tees on the course or courses of any
affiliated Club or Clubs.
b. Single Events - Field must constitute ten (10) players.
Four Ball Events - Field must constitute sixteen (16) players.
c. All Ladies competitions shall be open except major events such as Monthly
Medals and Club Championships
d. MEDAL ROUNDS
i. Medal Rounds to be played in two (2) Divisions. Minimum field 15 covering
both
divisions. Rounds shall be a “within division” random draw. Winner
of each
Division to receive a Medal. If a tie for Medal there will be a count back as
per
GOLF AUSTRALIA Rules
ii. Medal of Medals players shall be first off the 1st tee, one Medal of Medals
player
in each group. If a tie there will be an eighteen (18) hole play off on the
next
available agreed day within the week. Compulsory day Friday. If still tied,
then
sudden death.
iii. Overall putting winner – in the event of a tie each of those competitors
shall
receive a trophy
e. MATCHPLAY
i. 4BBB - 8 pairs to qualify for positions from Combined Aggregate Stroke as
per Fixture Book. Handicaps will be frozen as at first round.
ii. Single - All Ladies are eligible to play. Played in two (2) Divisions. Handicaps
will be frozen as at first round.
iii. If due to unforeseen circumstances you are unable to play after nominating
please notify the Captain before the draw
iv. Anyone who must forfeit during Matchplay must notify the Captain immediately
they know
v. Official day is Friday, however, you may play on any other day within the
week
that is acceptable to all parties, but not on Wednesday, Ladies Competition
Day.
vi. Be on time for arranged Tee off. For 4BBB if your partner is late, the other
pair
have every right to Tee off and you would play the holes until your partner
arrives and joins you.
vii. Play to commence from the 1st tee using permanent markers. If square after
eighteen (18) holes then sudden death. Shots to be given where applicable.
viii Please advise opponents if using caddies.
ix. Referee to be provided for all finals
f. CLUB CHAMPIONSHIPS
i. Seventy two (72) hole event played over four (4) rounds of eighteen (18)
holes.
ii. A, B & C Grades. Best Gross and Best Nett.
iii. Handicaps frozen for seventy two (72) hole event. Handicaps adjusted daily
for
daily event.
iv. One (1) major trophy per person for closed championships.
v. Veterans championship (Gross & Nett) to be played in conjunction. One
(1)
major trophy per person.
vi. In groups of three (3) wherever possible using 1st and 10th tees. For first
round A & B grades off 1st tee, C grade off 10th tee. For second round
reverse order then repeat above for rounds 3 & 4.
vii First draw graded in handicap. 2nd, 3rd and 4th rounds aggregate gross score.
viii. No caddies to be supplied during course of play.
ix. Cards must be presented daily within thirty (30) minutes of last finishing
round.
x. Nett events – count back as per GOLF AUSTRALIA Rules.
xi. After 1st round, limit of five (5) minutes late for starting time (rule
6-3a). Two
(2) stroke penalty on first hole.
xii. In the event of a tie, play off over a further eighteen (18) holes the
next
agreeable available day. In the event of a further tie then sudden death.
g. FOURSOMES
i. Thirty six (36) hole event played over two (2) rounds of eighteen (18) holes
on Wednesday and Thursday.
ii. Partners tee off alternate tees, reverse order day two (if odds day one
then
evens day two)
iii All players off 1st tee, seeded in combined handicap order day one. Seeded
draw (gross) day two.
iv. In the event of a tie, play off over a further eighteen (18) holes the next
available agreeable day within the week. Compulsory day Friday. In the event
of a further tie then sudden death.
v. Nett event tie – count back as per GOLF AUSTRALIA Rules
4. MENS CONDITIONS OF PLAY
a. Any member wishing to obtain a handicap and use Tin Can Bay as his Home
Club must return three (3) eighteen (18) hole stroke round score cards played
from the Golf Australia Men’s tees on the course or courses of any affiliated
Club
or Clubs
b MEDAL ROUNDS
i. Medal rounds to be played in 3 Divisions Winner of each division to receive
a
Medal. Play in groups of four (4), where possible, as drawn by the starters
of
the day.
ii. Men not in the draw play at the end of field and are eligible for the Men’s
trophy but not the medal.
iii. Ladies may also play at end of field for a trophy as provided by donor
or club.
iv. Mixed groups of players in above categories ii. & iii. permitted.
v. All players compete for pin shots and ball rundown.
c. MATCHPLAY
i.. 4BBB Handicap event. Eight (8) qualifying teams from 4B Stroke Aggregate
as per Fixture Book
ii. Single Scratch Event. Maximum eight (8) qualifiers from each division in
Championship rounds.
iii. First round of 4BBB allowed eight (8) days. Matches to be played within
one
week (or as directed by Match Committee) but not in Saturday Fixture times.
iv. Players must nominate before first round.
v. Draw as per GOLF AUSTRALIA Rules and Regulations.
vi. Play to commence from 1st tee if available, otherwise 10th. If square after
eighteen (18) holes sudden death from tee first played. Shots to be given
where applicable.
vii.Be on time for arranged tee off. If your partner is late the other pair
have
every right to tee off and you would play the other pair until your partner
arrives and joins you.
viii.Please advise opponents if using caddies. No caddies to join group after
commencement of play.
ix. Results to be handed to Match Committee or displayed by 5pm on the next
Sunday.
d. CLUB CHAMPIONSHIPS
i. Seventy two (72) hole event played over four (4) rounds of eighteen (18)
holes.
ii. Compete in 4 Grades A, B, C and D. Best Gross and Best Nett
iii. Handicaps frozen for seventy two (72) hole event. Handicaps adjusted daily
for daily event.
iv. One (1) major trophy per person for closed championships.
v. Nominations - Close 2pm on day prior to Round 1.
vi. In groups of three (3) wherever possible using 1st and 10th tees.
vii. Rounds 1 & 2 drawn in Grades with overlap of A & B and/or B &
C
and/or C & D where necessary
viii. In Rounds 3 & 4 graded draw on gross score (within Grades where possible)
although any B, C or D player(s) in contention for Club Champion to play in
leading group(s).
ix. Committee decisions on late nominations are final
x. Time sheets for Rounds 1 & 2 will be displayed by 5pm on Friday prior
to
Round 1.
xi. No caddies to be supplied during course of play.
xii. Cards must be presented daily within thirty (30) minutes of last finishing
round.
xiii. After 1st round, limit of five (5) minutes late for starting time (rule
6-3a).
Two (2) stroke penalty on first hole.
e. IN THE EVENT OF A TIE
i. Monthly Medals will be decided by a count back as per GOLF AUSTRALIA
Rules.
ii. Medal of Medals is an eighteen (18) hole playoff. If still a tie then sudden
death
iii All other Club Championship Events to be decided by an eighteen (18) hole
playoff, time and day to be set by Match Committee - if still no decision then
sudden death from 1st tee
iv. Men’s Open Championship – sudden death from 1st tee.
v. All other Events by count back system as per GOLF AUSTRALIA Rules
and Regulations.
f. FOURSOME EVENTS
i. All competitors must hold a current GOLF AUSTRALIA handicap as
applicable
ii. All teams play from 1st tee.
iii. Mixed – Ladies tee off odd numbered holes first eighteen (18). Reverse
for
second eighteen (18),
iv. Men – Either player may tee off odd numbered holes first eighteen
(18).
Reverse for second eighteen (18).
g. 27 HOLE EVENTS
In the event of bad weather, or for any other reason, the Match Committee
reserves the right to shorten the contest and/or vary any conditions they deem
necessary including the allocation of prizes.
